Recently, a Federal Judge denied a crucial motion filed by Wal-Mart officials allowing the Tracy Morgan injury lawsuit against Wal-Mart to proceed. The famous comedian and star of 30 Rock was severely injured when the vehicle he was in collided with a Wal-Mart semi-truck in New Jersey.
Morgan is still recovering from the injury that occurred on June 7th, 2014. One of Morgan’s friends and fellow comedians, James ‘Jimmy Mack’ McNair, was killed in the car accident. Morgan suffered a broken leg and ribs.
As a result of the accident, Morgan sued Wal-Mart officials for negligence, and, in response, Kevin Roper’s (the Wal-Mart truck driver) attorney filed a motion to put the Tracy Morgan injury lawsuit on hold until Roper’s wrongful death criminal case has concluded. The intent of the motion was to stop any incriminating statements made in the Wal-Mart case to impact the ongoing criminal case.
Last Friday, the US District Court Judge presiding over the case denied the motion stating that Roper failed to prove that he required “emergent relief.” As a result, the Tracy Morgan injury lawsuit will proceed.
