Who can file bankruptcy?
You can file for bankruptcy if you pass the Eligibility and Means Test. There are different income limits for Chapter 7 and Chapter 13. If you have already declared bankruptcy and had your bankruptcy discharged, you won’t be able to declare again for six to eight years.
How does the Chapter 7 “Means Test” work?
The means test allows the courts to discover who qualifies for debt elimination through bankruptcy. It compares your monthly expenses to your current monthly income over a six month period of time. This allows the courts to see what your monthly disposable income would be. If your monthly disposable income is too high, you won’t be allowed to use Chapter 7 and will likely need to declare a Chapter 13 bankruptcy.
How long does a bankruptcy typically take?
When Chapter 7 is used, the process typically takes four to six months.
When I file bankruptcy, does that stop creditors from taking my things?
When a Chapter 7 is filed, the court puts into effect an “Order for Relief”. This immediately will disallow creditors from legally going after your assets. After filing, they are no longer able to go after your car, take your house, or access your bank account. They also will not be able to garnish your wages. This is a temporary measure until your case has been heard. The “Order for Relief” is more popularly called an automatic stay.
